Welcome to Ryan Recruit. These Terms of Service ("Terms") govern your access to and use of our cloud-based recruitment applicant tracking system (ATS) platform. By using Ryan Recruit, you agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you may not access or use Ryan Recruit.
1. Service Description
1.1 What We Provide
Ryan Recruit is a cloud-based recruitment applicant tracking system (ATS) designed to help small businesses, startups, recruiting agencies, and HR teams manage their hiring processes. Our platform provides:
- Job posting creation and management
- Candidate application tracking and pipeline management
- Team collaboration tools for hiring workflows
- Interview scheduling and management
- Candidate communication features
- Recruitment analytics and reporting
- Integration with third-party job boards and tools
1.2 Service Availability
We strive to provide 99.9% uptime for our services. However, we do not guarantee uninterrupted access, as maintenance, updates, or unforeseen technical issues may occasionally affect availability. We will notify users in advance of scheduled maintenance whenever possible.
1.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice of significant changes that materially affect your use of the platform.
2. User Obligations
2.1 Lawful Use
You agree to use Ryan Recruit only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to:
- Employment discrimination laws (EEOC, Title VII, ADA, etc.)
- Data protection and privacy laws (GDPR, CCPA, etc.)
- Labor and employment regulations in your jurisdiction
- Anti-spam and electronic communications laws
2.2 Accurate Information
You must provide accurate, current, and complete information when creating your account and using our services. You are responsible for maintaining the accuracy of your account information and updating it promptly when changes occur.
2.3 Prohibited Activities
You agree not to:
- Use the service to post discriminatory, offensive, or illegal job postings
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our services
- Reverse engineer, decompile, or attempt to extract source code from our platform
- Use automated scripts or bots to access the service without authorization
- Resell, sublicense, or transfer your account to third parties without permission
- Upload malware, viruses, or other harmful code
2.4 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
3. Account Terms
3.1 Eligibility
To create an account and use Ryan Recruit, you must:
- Be at least 18 years of age
- Be authorized to represent your company or organization
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using our services under applicable laws
3.2 Account Registration
When you create an account, you must provide a valid email address, company information, and create a secure password. Each account is tied to a single company or organization. Multiple team members from the same organization can be added as users under a single account.
3.3 One Account Per Company
Each company or organization is permitted one active account. Creating multiple accounts for the same organization to circumvent pricing or usage limits is prohibited and may result in account suspension.
3.4 User Roles and Permissions
Account administrators can add team members and assign roles with different permission levels. Administrators are responsible for managing user access and ensuring team members comply with these Terms.
4. Payment Terms
4.1 Pricing
Ryan Recruit is offered at $1 per month per user. This pricing is transparent and includes access to all platform features with no hidden fees or premium tiers.
4.2 Billing Cycle
Subscriptions are billed monthly in advance. Your billing cycle begins on the date you subscribe and renews automatically each month on the same date. You will be charged for the number of active users in your account.
4.3 Payment Methods
We accept major credit cards (Visa, MasterCard, American Express) and debit cards. Payment is processed automatically through our secure payment processor. You authorize us to charge your payment method for all subscription fees.
4.4 Price Changes
We commit to maintaining the $1/month per user pricing for existing customers. If we ever change our pricing structure, existing subscribers will be grandfathered in at their current rate. New pricing would only apply to new customers.
4.5 Failed Payments
If a payment fails, we will attempt to charge your payment method up to three times over the following two weeks. If payment cannot be processed, your account may be suspended until payment is received. We will notify you via email before any suspension occurs.
4.6 Refunds
We offer prorated refunds for annual subscriptions if you cancel within 30 days of payment. Monthly subscriptions are non-refundable, but you can cancel at any time to prevent future charges. Your access continues until the end of your current billing period.
4.7 Taxes
All fees are exclusive of applicable taxes (including VAT, GST, or sales tax). You are responsible for paying any taxes associated with your subscription, and we will charge these taxes if required by law.
5. Intellectual Property
5.1 Platform Ownership
Ryan Recruit, including all software, designs, graphics, interfaces, code, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for your recruitment activities.
5.2 Your Data Ownership
You retain all ownership rights to the data you upload to Ryan Recruit, including:
- Job postings and descriptions
- Candidate information and resumes
- Communication histories
- Company information and branding
- Custom fields and settings
We will never sell, share, or use your data for purposes other than providing our services to you.
5.3 License to Your Content
By uploading content to Ryan Recruit, you grant us a limited license to store, process, and display your content solely for the purpose of providing our services. This license terminates when you delete your content or close your account.
5.4 Trademarks
"Ryan Recruit" and our logo are trademarks. You may not use our trademarks without prior written permission, except as necessary to identify our services.
6. Liability Limitations
6.1 Service "As Is"
Ryan Recruit is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure.
6.2 Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims arising from your use of Ryan Recruit is limited to the total amount of subscription fees you paid in the 12 months preceding the claim.
We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or business opportunities
- Data loss or corruption (though we maintain regular backups)
- Third-party actions or content
- Hiring decisions or employment outcomes
6.3 User Responsibility
You are solely responsible for your hiring decisions, compliance with employment laws, and how you use candidate data. Ryan Recruit is a tool to facilitate recruitment processes, but final hiring decisions and legal compliance rest with you.
6.4 Data Backup
While we maintain regular backups of all data, we recommend you export and maintain your own copies of critical information. We are not liable for data loss, though we will make reasonable efforts to recover data in the event of a technical failure.
7. Termination Policy
7.1 Cancellation by You
You may cancel your subscription at any time with 30 days' notice. To cancel:
- Log into your account and navigate to Settings → Subscription
- Click "Cancel Subscription" and confirm
- Your access will continue until the end of your current billing period
- No refunds for partial months, but you can use the service until the period ends
7.2 Cancellation by Us
We may suspend or terminate your account with 30 days' notice if:
- You violate these Terms of Service
- Your account has unpaid fees after multiple payment attempts
- You engage in fraudulent or illegal activity
- Your use of the service poses security or legal risks to us or other users
In cases of serious violations (fraud, illegal activity, security threats), we may terminate immediately without notice.
7.3 Data Export and Deletion
Upon cancellation or termination:
- You have 30 days to export your data before it is permanently deleted
- We will provide data export functionality in common formats (CSV, JSON)
- After 30 days, all your data will be permanently deleted from our systems
- We may retain certain information as required by law or for legitimate business purposes
7.4 Reactivation
If you cancel and wish to reactivate within 30 days, you can restore your account with all data intact. After 30 days, you will need to create a new account, and previous data will not be recoverable.
8. Dispute Resolution
8.1 Informal Resolution
If you have a dispute with Ryan Recruit, please contact us first at support@ryanrecruit.com. We will make a good faith effort to resolve the issue informally within 30 days.
8.2 Binding Arbitration
If we cannot resolve a dispute informally, you agree that any legal dispute will be resolved through binding arbitration rather than in court. Arbitration will be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA).
8.3 Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration against Ryan Recruit.
8.4 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any arbitration or legal proceedings will take place in Delaware.
8.5 Small Claims Court
Either party may bring a claim in small claims court instead of arbitration if the claim qualifies for small claims court jurisdiction.
9. Changes to Terms
9.1 Updates and Modifications
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make changes:
- We will update the "Last Updated" date at the top of this page
- We will notify you via email at least 30 days before changes take effect
- For material changes, we will provide a summary of key updates
9.2 Your Acceptance
By continuing to use Ryan Recruit after changes take effect, you agree to the updated Terms. If you do not agree with the changes, you may cancel your subscription before the changes take effect.

Acknowledgment
By using Ryan Recruit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are using Ryan Recruit on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
